§ 1 Scope of Application
These Terms and Conditions apply to all orders between Nicola Maisto - 9bar-Studio and its customers in the area of maintenance, repair, and restoration of espresso machines and coffee grinders.
§ 2 Formation of Contract
The contract is formed by our written or verbal order confirmation, or by the commencement of the agreed work.
§ 3 Prices and Payment
The prices communicated by us at the time of order confirmation apply. For machine servicing, we provide a binding cost estimate before work begins (except for emergency service calls, which are billed hourly at the agreed rate). Payment is due upon acceptance of the work, by bank transfer or card.
§ 4 Diagnosis
The initial diagnosis is free of charge. If no order results from it, transport costs are only charged if the machine was brought to our workshop at our request.
§ 5 Warranty
We provide a 12-month warranty on all work performed, starting from the date of handover. Original parts installed are covered by the manufacturer's warranty, but at least 12 months. Statutory warranty rights (gesetzliche Gewährleistung) remain unaffected.
§ 6 Retention of Title
Installed spare parts remain our property until full payment has been received.
§ 7 Liability
We are liable without limitation for intent and gross negligence, for damages to life, body, and health caused by ordinary negligence, and under the provisions of the German Product Liability Act (Produkthaftungsgesetz). Beyond this, liability is limited to typical, foreseeable damages for this type of contract.
§ 8 Place of Performance and Jurisdiction
The place of performance is Oranienburg. For merchants (Kaufleute within the meaning of the German Commercial Code), Oranienburg is the exclusive place of jurisdiction.
